TapNota Terms & Conditions

1. Acceptance of Terms

By accessing or using TapNota (“Service”), you agree to these Terms & Conditions (“Terms”). If you do not agree, you may not use the Service. These Terms apply to all users, including Free, Pro, Business, and bulk Tag ID purchasers.

2. Description of Service

TapNota connects physical items to digital pages using:
  • NFC tags
  • Unique TapNota URLs
  • QR codes (when using bulk Tag IDs)
You can create and manage:
  • Notes
  • Photos
  • Ownership records
  • Activity history
  • Status updates
TapNota provides both the digital platform and, in some cases, physical NFC tags associated with the Service. While TapNota supplies the tools, users are solely responsible for how tags, URLs, and associated pages are deployed, accessed, and used.

3. Tag IDs, URLs & QR Code Use

  • Each tag or URL is tied to a unique ID
  • Bulk users may:
    • Use their own NFC tags
    • Create QR codes from TapNota URLs
    • Deploy tags independently
TapNota is not responsible for:
  • Third-party tag or QR code usage
  • Unauthorized duplication or sharing
  • How Tag IDs are used after delivery

4. Ownership & First Activation Rule

The first person to activate a TapNota tag or URL gains control of that page. This includes control over:
  • Page setup
  • Visibility settings
  • PIN/passcode (if available)
Important: If no PIN is set, anyone with access to the tag, URL, or QR code may take control and set their own PIN.
TapNota does not resolve ownership disputes.

5. Access Levels, URLs & Permissions

Primary (Owner) URL

  • The original TapNota URL is the control URL
  • Allows full editing and settings access
  • Used to manage the page
Warning: Anyone with this URL may gain control if no PIN is set.

Public

  • Accessible to anyone
  • May be indexed by search engines

Shared (Read-Only Access)

  • The owner can generate a separate Share URL
  • This Share URL:
    • Allows viewing notes and content
    • Does NOT allow editing
    • Does NOT allow control changes
This allows safe sharing without giving control.
Important:
  • Only the owner URL has editing/control permissions
  • You are responsible for which URL you share
  • TapNota does not guarantee users will distinguish between owner and share URLs

Private

  • Restricted access
  • May require login or PIN

6. Search Engine Indexing

  • Public pages may appear in search engines
  • Private and Shared pages use noindex directives
However:
  • Search engines may still cache content
  • TapNota does not control third-party indexing behavior

7. PIN / Passcode Protection (Pro & Business)

  • Optional feature
  • You are responsible for securing your PIN
TapNota is not responsible for:
  • Unauthorized access due to weak or missing PINs
  • Loss of control when no PIN is set

8. User Responsibility for Content

You are fully responsible for any content you create, including:
  • Notes
  • Photos
  • Data
You agree NOT to use TapNota for:
  • Illegal activity
  • Harassment or abuse
  • Sensitive or confidential data storage
  • Violating laws or rights

9. Lost, Stolen, or Misused Tags / URLs

TapNota LLC is not responsible for:
  • Lost or stolen tags
  • Shared or leaked URLs
  • QR codes accessed by unintended users
  • Unauthorized access or edits
Physical access to a tag or URL may grant access to its page.

10. Bulk Tag ID Purchases

You are responsible for:
  • Writing tags
  • Creating QR codes
  • Deployment and distribution
  • Security and access control
TapNota does not control usage after delivery.

11. No Guarantee of Service

TapNota is provided “as is.”
  • No guaranteed uptime
  • No guaranteed data permanence
  • No guarantee of error-free operation

12. Limitation of Liability

To the fullest extent permitted by law, TapNota LLC is not liable for:
  • Data loss
  • Unauthorized access
  • Tag misuse
  • Lost or stolen items
  • Business or financial losses
  • Indirect or consequential damages
Use of the Service is at your own risk.

13. Payments & Subscriptions

  • Subscriptions are billed as stated
  • Fees are non-refundable unless required by law
  • Features vary by plan
TapNota may change pricing or features at any time.

14. Termination

TapNota may suspend or terminate accounts for violations or misuse. You may stop using the Service at any time.

15. Modifications to Terms

We may update these Terms at any time. Continued use = acceptance.

16. Governing Law

These Terms are governed by the laws of the State of Texas, United States.
